Terms of Service

By accessing or using BuildWith, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. We reserve the right to update these terms at any time, and your continued use of the platform constitutes acceptance of any changes.

BuildWith is a marketplace platform that connects clients with AI-native builders for software development projects. Our services include:

• Project posting and builder matching
• Secure messaging between clients and builders
• Milestone-based project management
• Escrow payment processing via Stripe
• Review and rating systems

To use certain features of BuildWith, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Not create multiple accounts or impersonate others

BuildWith uses Stripe Connect for payment processing with milestone-based escrow:

• Clients fund milestones before work begins, with funds held in secure escrow
• Payments are released to builders upon client approval of completed milestones
• BuildWith charges a platform fee on completed transactions
• Disputes are handled through our resolution process before escalation to Stripe
• All payments are subject to Stripe's terms of service

Users agree not to engage in the following prohibited activities:

• Circumventing the platform to avoid fees
• Posting false, misleading, or fraudulent content
• Harassing, threatening, or abusing other users
• Violating intellectual property rights
• Using the platform for illegal activities
• Attempting to compromise platform security

BuildWith provides the platform "as is" and makes no warranties regarding the quality of work performed by builders. We are not liable for disputes between users, the quality of deliverables, or any indirect, incidental, or consequential damages. Our total liability is limited to the fees paid to BuildWith in the twelve months preceding any claim.

Ownership of work product is determined by the agreement between clients and builders. By default, upon full payment, clients receive ownership of all deliverables created specifically for their project. Builders retain rights to pre-existing work and may retain portfolio rights unless otherwise agreed.

We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our discretion. Users may close their accounts at any time, subject to completion of outstanding projects and payment obligations.
